ZarpVoIP, Terms and Conditions of Use

1. TERMS OF SERVICE

1.1. These terms of service constitute the agreement between ZarpVoIP (we or us) and the end user (you, your or customer). By activating or using any of the services, you represent that you are authorized to enter into this agreement and that you have read and understood the terms and conditions of this agreement.

1.2. Additional terms may apply to your use of some of our services. If so, we will tell you what those terms are. If there is any conflict between these terms and any additional terms, the additional terms will prevail.

2. OUR SERVICES

2.1. We are not obliged to provide services unless we accept your application. We can decide whether or not to accept any application.

2.2. You understand that the VoIP service is not a traditional phone service and is provided on a best efforts basis. We will use all reasonable endeavours to make our services available to you at all times, however things beyond our control such as power outages or the performance of your IP connection to our service may disrupt the service we provide.

2.3. You accept that our services are not required to support emergency calls.

2.4. Unless otherwise agreed, we do not provide or support your internet connection. You accept that ZarpVoIP might not be compatible with non-voice communications equipment such as alarms, fax machines, Foxtel and St John Alarms.

3. CHARGES AND PAYMENT

3.1. To use our payable services, you must have a credit balance on your account and agree to use the provided BPAY or Credit Card deposit facilities to deposit a credit balance onto your account and this can be done online at live.zarpvoip.com or via the B-pay facility provided by your bank.

3.2. We reserve the right to change our rates from time to time and if we increase any rates we will give you as much notice as reasonably possible. The latest rates are available on our website www.zarpvoip.com

3.3. You are responsible for your account and must pay our charges regardless of whether you or someone else uses those services.

3.4. If you wish to raise a billing dispute you must notify us in email within 30 days of your account being debited or you will be deemed to have waived your right to a refund.

3.5. No refunds will be provided for any unused credit balances. A credit balance for an account that has been inactive for 3 months will be lost.

4. USING OUR SERVICES

4.1. You must not use our services (or permit our services to be used) in a way that: breaks any laws or infringes anyone’s rights or in a way which is malicious, obscene or offensive.

4.2. You agree to provide us with accurate and correct information so we can provide you with the necessary services or contact you if required from time to time.

4.3. We can suspend or restrict the services we provide you at any time if:
i) you resell any of our services;
ii) you primarily use our service for inbound calling only;
iii) you do not use the service sensibly and within our reasonable use guidelines set out in 4.4 below;
vi) we believe that you have breached any of our terms and conditions.

4.4. Unlimited local and worldwide minutes on ZarpVoIP plans are available on the basis of reasonable use. If you use the service in a way that is inconsistent with the normal use for your service or plan we may:
i) monitor and investigate your usage; and
ii) suspend and/or withdraw the Service; or
iii) charge our standard per minute rate for additional calls

4.5 You must keep secure any password or PIN number which is used by you to access our services and ensure that is it not disclosed to any unauthorized person. You must also change your password or PIN number if we ask you to do so.

4.6. If your service is cancelled, terminated or reallocated you will relinquish and discontinue use of any numbers, voicemail access numbers and/or web portals assigned to you by ZarpVoIP.

5. PHONE NUMBERS

5.1. Any phone number that we allocate to you does not become your property and does not constitute any transfer of property rights.

5.2. If we need to change your number, we will send you notification by email and give you as much notice as possible.

5.3. We can withdraw or terminate any number at any time without liability.

5.4. You may be able to port your ZarpVoIP number to another service provider. If you wish to do so you must contact the other service provider directly and you will be responsible for completing the Porting requirements of that service provider. We will comply with our obligations under the Terms for Local Number Portability in relation to the porting of your number. You will be responsible for all costs associated with porting the number.

5.5. If your account is inactive for more than four months or cancelled and you have not ported the associated phone number(s), we may at our sole discretion reallocate the number(s) associated with your account.

6. TERM

6.1. We can terminate this agreement, or the provision of any service to you, immediately if you breach any term of this agreement or if we reasonably believe that you have supplied incorrect or misleading information to us.

6.2. We can terminate this agreement, or the provision of any service to you, if your account is inactive for four months or longer. Inactive may include no calling activity and/or no payments made into the account. Where accounts are terminated for inactivity, numbers attached to that account cannot be ported away from billing.zarpvoip.com in accordance with 5.5 above.

6.3. If this agreement is terminated for any breach or misuse of the service, you are not entitled to a refund for any credit balances on your account, unless agreed otherwise.

6.4. In order to terminate your service or account in full, you must email us at the following address sales@zarpvoip.com. Termination will not take effect until the end of your current prepaid month.

7. LIABILITY

7.1. We exclude all of our liability to you in connection with us providing services to you or failing to provide services to you. Without limiting this, we are not liable to you (and nor are any of our officers, employees, bank, contractors or agents liable to you):
i) if any communication is intercepted, not properly transmitted or received;
ii) for any disruptions or delays with the use of our services;
iii) for any incompatibility with other services;
iv) if any software we supply does not operate properly; and
v) for any equipment or network failures.

7.2. We are not liable to you for any fault in, delay or non-provision of services which is caused by an event beyond our reasonable control.

7.3. If you use another service provider during any period when our service is not fully operational, we are not liable to pay any amount you are charged by that service provider.

7.4. You acknowledge that no third party whose network or services we use to supply services to you (nor any officer, employee, bank, contractor or agent of such third party) is in any way liable to you in connection with our services.

7.5. Nothing in this clause limits any rights you have under the Consumer Guarantees Act.

8. PRIVACY

8.1. We will collect personal information from customers to provide and provision services, including but not limited to name, physical address, email address, contact phone number and credit card information.

8.2. Any personal information we collect is kept at our offices. You are entitled to see any information we hold about you, although you must pay our reasonable charge for making it available.

8.3. Except where we provide private encrypted links, when transmitting voice and other communications via the public internet and third party networks we are not liable for any lack of privacy with the service.

9. CHANGING THESE TERMS

9.1. We can change these terms from time to time by altering the version available on the ZarpVoIP website at www.zarpvoip.com.

10. NOTICES

10.1. ZarpVoIP will communicate with you primarily via email. Notices to you will be sent to the email address specified by you during sign up for service or as subsequently specified by you as your contact email address in your ZarpVoIP online account. We may also obtain personal information from your use of our services.

10.2. If your contact email address changes you must update your ZarpVoIP online account with new details as soon as possible.

10.3 You agree that sending a message to your contact email address is the agreed means of providing notification. Notifications include information about the service, billing, changes to services and other information. You are required to read any email sent to your contact email address in a timely manner to avoid any potential disruption to your service.

11. OTHER MATTERS

11.1. These terms are to be interpreted in accordance with the laws of the Supreme Court of Queensland. Any dispute regarding the provision of our services under these terms is to be determined in The Supreme Court of Queensland.

11.2. You must not assign your rights under this agreement. We can transfer our rights and obligations under this agreement to anyone else. We will notify you if we do so.

11.3. A delay in exercising any right is not a waiver of that right. A failure to exercise a right on any occasion does not prevent any subsequent exercise of that right.

ZarpVoIP is Prepay Calling Service

Once you sign up for a ZarpVoIP account, all services that you purchase are to be pre-paid in advance. This includes calling, system extras and add-ons, equipment purchases and number porting. You will need to ensure that your account is always in credit to ensure there is no disruption to your calling service.

ZarpVoIP is a prepay service just like many other VoIP services and subscriptions available today. There are not contracts for calling and no setup fees.

How to Top-Up your account.

If you don’t want to use a credit card to top up your account, you can pay via direct credit from your bank. Here’s our bank details.

ZarpVoIP Calling Bundle

Terms and Conditions

1. Contract term: 12 months
2. 2 Month expiry for all inclusions and for use in Australia only.
3. Calling Rates: All published rates are billed in 30 second increments.
4. Prepaid minutes: All plans are prepaid. Unused monthly calling allowance will not be credited to the following month.
5. All rates are subject to change without notice.
6. ZarpVoIP’s phone bundles otherwise referred to as “ZarpVoIP calls” are rented to you on a 12 months‘ contract. All CPE supplied by ZarpVoIP will be replaced if faulty for the term of your contract. All legal title in supplied customer premise equipment remains with ZarpVoIP.

Zarptalk Calling Plan

Terms and Conditions

1. Zarptalk is a Pay-As-You-Go plan which requires your account to have a positive credit balance which is debited when calls are made.
2. Duration of Untimed Calls local and national calls is a maximum of 60 minutes per call.
3. Calls over 60 minutes’ duration will be charged a per minute overage rate.
4. 2 Month expiry for all inclusions and for use in Australia only.
5. Calling Rates: All published rates are billed in 30 second increments.
6. Prepaid minutes: All plans are prepaid. Unused monthly calling allowance will not be credited to the following month and is not transferable.
7. All rates are subject to change without notice but will not alter during the period of your prepaid credit.

B2B Web Conferencing

Terms and Conditions

1. B2B conferencing is provided as a “free” service to ZarpVoIP customers.
2. ZarpVoIP reserve the right to withdraw the service at any time.
3. ZarpVoIP exclude all liability for any loss or damage caused by use of B2B Web Conferencing.

HOW WE TREAT THE INFORMATION YOU PROVIDE ON THIS WEBSITE

We take the protection of your information seriously and we’re committed to protecting your privacy at all times when on our website. We’d like to share with you the principles that govern our privacy practices.

INFORMATION COLLECTED

When you request additional information, or register for services, ZarpVoIP will ask you to provide basic contact information. When you purchase services online, we request billing information. ZarpVoIP uses common Internet technologies, such as cookies and Web beacons, to keep track of interactions with the zarpvoip websites and emails.

USE OF INFORMATION

ZarpVoIP uses information collected to provide you with the services you request. ZarpVoIP may use information collected to provide you with additional information about our services, partners, promotions, and events. We may use information collected to improve the Company’s websites and services. ZarpVoIP does not share, sell, rent, or trade personally identifiable information with third parties for their promotional purposes. We may share information collected with other companies that work on our behalf.

COMMUNICATIONS PREFERENCES

ZarpVoIP sends billing information, product information, service updates and regular customer newsletters to registered Users via email. Every marketing email from www.zarpvoip.com contains instructions on how to opt out of receiving further marketing emails from the office.

CUSTOMER DATA

ZarpVoIP will not review, share, distribute, or reference any such Customer Data except as may be required by law. Individual records of Customer Data may be viewed or accessed only for the purpose of resolving a problem, support issues, or suspected violation of the ZarpVoIP Terms of Use or as may be required by law.

Zarp-connect Calling Bundle

1. Zarp-connect is a pre-pay calling bundle which requires your account to have a positive credit balance in order to make calls.

Zarp-city E-Sign Consent

Important Notice: In order to create a city Account, (used herein, a “Zarpcity Account”), as defined in the Zarpcity Terms of Use, Zarpcity must provide certain disclosures required by the Australian Communications and Media Authority (ACMA). Zarpcity can only provide these disclosures and other information electronically if the applicant consents.

1. Definitions

In this E-Sign Consent, the following definitions apply: “I” and “me” mean the person who is applying to establish a Zarpcity Account. “You” means Zarpcity and any person, company, bank or financial institution that is an assignee of Zarpcity’s rights.

2. Consumer Consent

By checking the “I agree to have the Terms and Conditions presented electronically,” which I hereby adopt as my electronic signature, I affirmatively consent and agree that:

» You can provide all disclosures required by law and other information about my legal rights and duties to me electronically.

» My electronic signature on agreements and documents has the same effect as if I signed them in ink.

You can send all communications, billing statements and disclosures, including, but not limited to, this Zarpcity E-Sign Consent, the Zarpcity Privacy Policy, Zarpcity Service Schedules and all tax statements and documents (collectively defined as “Disclosures”) to me electronically (1) via email, (2) by access to a web site that you designate in an e-mail notice you send to me at the time the information is available, or (3) to the extent permissible by law, by access to a web site that you generally designate in advance for such purpose.

3. What I Will Need

I understand that in order to access and retain the electronic Disclosures I will need the following:

» A computer with an Internet connection.

» A current web browser that includes 128-bit encryption. Minimum recommended browser standards are Microsoft Internet Explorer version 8.0 and above (see www.microsoft.com/ie for current version), Mozilla Firefox current version (see www.mozilla.com for current version), Apple Safari current version (see www.apple.com/safari for current version), or Opera current version (see www.opera.com for current version). The browser must have cookies enabled.

» A valid email address.

» Sufficient storage space to save past Disclosures and/or an installed printer to print them.

» If I use a spam filter that blocks or re-routes emails from senders not listed in my email address book, I must add noreply@zarpvoip.com to my email address book.

4. Requesting Paper Documents and Withdrawing Consent

I understand that I may request paper copies of the Disclosures within 180 days of the date of the Disclosure, and that you will provide them to me by mail at no charge. I understand that I have the right to receive these Disclosures in paper form. I can request paper copies and/or withdraw consent by contacting you at:

Any withdrawal of my consent to receive electronic Disclosures will be effective only after you have a reasonable period of time to process my withdrawal. I understand and agree that if I withdraw my consent to receive electronic Disclosures you may – though you are not obligated to – cancel my Zarpcity Account.

5. Updating Email Address

I can change my email address by signing into my Zarpcity Account at any time. I can also do this by contacting you at:

6. Legal Effect

By consenting, I agree that electronic Disclosures have the same meaning and effect as if you provided paper Disclosures to me. When you send me an email or other electronic notification alerting me that the Disclosure is available electronically and you do in fact make it available online, that shall have the same meaning and effect as if you provided a paper Disclosure to me, whether or not I choose to view the Disclosure, unless I had previously withdrawn my consent to receive Disclosures electronically. I understand and agree that Disclosures are considered received by me within 24 hours of the time posted to your website, or within 24 hours of the time emailed to me unless you receive notice that the email was not delivered.

7. General

I understand and agree that you reserve the right to cancel this electronic Disclosure service, change the terms of use of this service or send Disclosures in paper form at any time. I understand and agree that you are responsible for sending notice of the Disclosures to me electronically including at the email address I have provided, but are not responsible for any delay or failure in my receipt of the email notices.

Account and Service Cancellation

For all Zarpcity calling plans and bundles, these are on a month-by-month pre-paid basis, so no early termination or cancellation fees apply. For Zarpcity’s voice conferencing, these are supplied on either 12, 24 month contracts with early termination fees payable on the remainder of the contract when cancelled prior to the termination date. A minimum of 30 days’ notice is required to terminate any existing Voice Conferencing.

Cancellation Policy.

» Any service or account cancellations will take effect on your bill anniversary date.
» Any remaining account credits on the date will be lost if you cancel.

In order to terminate your service or account in full, you must email us at the following address customercentre@zarpvoip.com. Termination will not take effect until the end of your current prepaid month.
